BSG: COMPULSORY SOCIAL INSURANCE FOR MUSIC SCHOOL TEACHERS

The Federal Social Court (BSG) had to decide whether a music teacher at a municipal music school is subject to social security contributions if he has to adhere to the curriculum of the Association of German Music Schools in his teaching.

In its ruling of 14.03.2018 (BSG, B 12 R 3/17 R), the court ruled that the obligation imposed on the music teacher by the school authority to use a specific curriculum as the basis for his lessons does not lead to the assumption of a relationship subject to social insurance contributions. This also applies to the obligation to hold lessons on the premises of the music school.

According to the BSG’s press release, the court considered it decisive “that the parties involved had agreed and lived an independent employment relationship.”
